What Changes Under Thailand's Crypto ETF Framework?

On October 8, 2026, Thailand's Securities and Exchange Commission announced that it had issued regulations governing cryptocurrency exchange-traded funds. The notifications are scheduled to take effect on October 16. The framework is intended to broaden investment opportunities while bringing crypto ETFs within an established fund-regulation structure and introducing additional investor safeguards.

During the initial phase, eligible crypto ETFs will be limited to bitcoin and ether. Funds must be managed as passive investment vehicles seeking to track the price of the relevant crypto asset and maintain average net exposure of at least 80% of net asset value to a single crypto asset over each accounting year. The funds must be listed and traded on the Stock Exchange of Thailand and use SEC-regulated digital asset custodians to safeguard fund assets.

Fund managers and service providers should translate regulatory requirements into operational procedures covering product eligibility, custodian due diligence, valuation, reconciliation, transaction monitoring, disclosures, and complaint handling. Where blockchain infrastructure is involved, records should identify wallet-control arrangements, asset movement, and authorization for significant operations.
